My question involves a driver's license issued by the State of: California
My son is now 33 yrs old; he got his first ticket (a DWI) and:
1. Has paid all fines.
2. Satisfied probation.
3. Completed DWI class for 1 year.
The issue is that he did not have a car (was driving mine and fell asleep; crashed.) The only other thing they required of him was IF he had a car, he was to get one of the devices placed on the ignition to verify he was driving sober (he does not drink, and there was no blood alcohol in him as per the 3 breathalyzer tests they conducted and the blood work they did at the jail. They dropped charges, we thought it was over, and then found out they had put a warrant out for his arrest. I took him to the police station, and they booked him again and set a new court date; during that court date, the prosecutor thought he now had THREE DWIs, and tried to get 2 yrs jail time, and my son told the judge it was only ONE DWI charge, not three...
We paid everything anyway because they were so messed up, we were afraid of what they might mess up next (yes, this REALLY happened this way!) So, the last requirement was the breathalyzer, which was $100 per month, but the paperwork said if he had no car, it was not required.
Now, when he goes to the DMV to try to get his license, the paperwork shows that he still has the requirement to have one of these on his car for a year. Again, he doesn't HAVE a car.
How can we fix this?? We can't afford an attorney.
