My question involves estate proceedings in the state of: NC I am wrapping up an estate and had a question about the small estate affidavit. The deposit account was joint but both owners are deceased. On the form there is a section Property of Estate. One option is accounts in sole name of decedent the second option is joint accounts without right of survivorship and has % amounts for each. Since I am filling out the affidavit for the last person who died which option should I list the account under.
The other part listed under Other Property are these questions. There is or is not entireties real estate owned by decedent and spouse. There is or is not insurance retirement plan IRA accounts payable to named beneficiaries. For these set of questions since the property has already been transferred out of the trust to the grantee and the IRA been transferred to the beneficaries. Which option would I select. I was thinking there would not be since everything has already been transferred.
