My question involves a consumer law issue in the State of: PA
As home sellers, we just underwent our home inspection. Upon completion, a note was left on the stair bannister that it was unstable and to call the inspector with any questions. Upon looking at the stairs, the inspector had dislodged 22 of 25 balusters/spindles from where they seat into the stairs or railing. The bannister was left in this state of disrepair. We had never had any issues with the bannister in the 7 years we have owned our home.
Upon calling the inspector, it was politely requested for him to come back and to place the bannister back to the condition it was prior to his arrival. His answer was "no, your bannister is in disrepair." The conversation escalated letting him know that we are well aware findings may be found during an inspection, but for him to leave our home with damage that was caused by him is unacceptable, especially when it comes to safety (we have a toddler at home).
As stated before, we are aware that findings may be found. But, we had 2 open houses just prior to this inspection and would not have been able to do so if the bannister was "in disrepair". Our home photographs for the listing do include one of the stairs and no disrepair is visible.
Does a seller in such a situation have the right to take legal action against the inspector as the stairs are in a worse condition than pre-inspection? We'd like for him to pay for the repair of the damage caused.
