My father has a self-proven will written before the death of a disinherited adult child. The disinherited adult child later dies. However, the will was never revised and reads as though the disinherited child is still alive. For consideration before probate is one surviving adult child, one disinherited deceased child named in the will, and one child who was deceased at the time the will was written and not mentioned in the will. No other child or grandchild is mentioned in the will. The only beneficiary according to the will is the one surviving son. There is no mention of grandchildren.
Are the children of the two now deceased adult children entitled to inherit based on the will? Does the fact that one child was disinherited have any effect on that child's own children's inheritance rights? There is no ambiguity in the wording disinheriting the child and it is carefully worded to show the testator intended to leave nothing to one child. Thank you.
