My question involves criminal records for the state of: Texas
I'm going to try and make this as short as possible so bare with me. I was arrested on May 11, 2008 for Criminal Destruction of Property $1500>$10000 which in Texas is a Felony offense and I was charged as an adult.. I had recently went to the doctor and was prescribed Lunesta for my sleep disorder and I had a very, very bad reaction to it that lead to me blacking out after taking it (sleep aids affect short term memory). I apparently got up and started trying to drive. At the time and was living with my partner and their parents and they wouldn't let me leave the house and called my mother to come get the car (it was in her name because I was 17 at the time). When she got there and tried to take the keys from me, I was told that I completely lost it. After my mom left, I took a wooden bat and started beating the car. They called my mom and she came back over and she called the police after she couldn't get me to calm down. Her only intention was for them to put me in overnight until the sleep aid wore off. They told her she had to file a report and when she did, they used and said she filed charges against me. I woke up 3 days later in a jail cell (I had no idea what was going on at the time). It wasn't until I called my mom that she told me. She bailed me out later that day and from there we had all the court stuff. It took months of getting rescheduled to finally be able for my case to be heard before the judge. I finally met my lawyer on the day of my hearing (my mom was with me). The lawyer told her that if she dropped the charges, that the state would 100% pick them up and go after me regardless if she would or wouldn't testify. I honestly had no idea what all of this meant at the time, I was just doing what the lawyer said. So when I went before the judgeand I told him what happened and my mom even told him this isn't what she wanted and that I was under the influence of a prescribed medication and that I have never had this type of behavior before. So the judge lowered it from a State Jail Felony to a Class A misdemeanor and gave me 18 months deferred adjudication, 100 hours of community service and $1666 in fines. I completed all this by August 2010 and haven't been in trouble since.
So that's the main story. I did leave some things out to make it shorter, but I can expand on things more if the need arises.
Now that I'm a little older and I have a little more knowledge, I found out that I signed documents after getting to the jail stating I understood what I was arrested for and what my bail was set at. I don't remember doing any of this because I wasn't in my right state of mind and didn't understand what i was signing and then the lawyer didn't give us correct information and didn't make sure that I understood what everything meant at my court hearing. Yes, I know I did it, but my mom was tricked and then scared into believing that she shouldn't drop the charges otherwise it would be worse for me. I'm only 26 now and I still can't believe this actually happened to me.
So I have two questions:
1. Is there anything I can do about this case since it's closed and over 6 years old?
2. If not, then what are my options as far as expulsion, sealing, or filing for non-disclosure?
