My question involves real estate located in the State of: Oklahoma
The utility company came out yesterday without notice and when I was not at home. I did not notice anything amiss when I got home so I put my toddler in the house and he did what he always does when we first get home--lets the dogs out of the house and goes into the backyard with them. I start unloading groceries and on my 2nd trip, I see one of my dogs run past me. I spend the next 40 minutes chasing them around the neighborhood. I get them back home and notice the gate is open (my toddler cannot do this by himself because there is a metal rod that goes into the ground that prevents the gate from being opened from the backyard). A board on the gate is also broken. I hear my toddler crying and go into the backyard to see that he has put one of those metal marking flags through his hand. The metal bottom was embedded in his hand about 1/2" on a diagonal. The utility company not only spray painted my backyard (which is understandable if you are marking lines), but left about a dozen metal flags in the yard that is strewn with children's toys and spray painted the fence (not overspray). I called the company and they essentially said, 'Sorry, but we had to mark the lines.'
My question is two fold, what are the rights of a resident when it comes to utility companies coming onto the property? I have lived in 9 different states and I clearly remember getting some notice of utility work that would either interrupt service or cause workers to be on my property. Email, text, letter, note on door--something! I truly feel violated--I left my house secure and I come home and unbeknownst to me someone was traipsing around my yard and my gate is wide open. I thought we were robbed or something and when I first heard my son crying, I thought whoever was in my backyard was still there and had him. Second, do I have any recourse for the property damage? They broke our gate, shouldn't they fix it?
