My question involves an injury that occurred in the state of: New Jersey
Hell All,
I was driving in the left lane on the interstate and was on a speed of 40-45 mph and was driving in the same lane for more than 15 min and I even observed the back car in my rear view mirror 5 mins ago but after that do not remember checking the rear view mirror because the traffic was very dense so I was completely concentrating on my driving , All of a sudden i was hit on the rear end of my vehicle by the back car that i noticed in the mirror 5 min ago , major impact for my car was on the driver side of the rear end , My car has clearly the marks and dent from the middle of the rear to the end of the driver side and for the opposite car from the middle of his front bumper to the passenger side his it was totally dented and he even had an airbag deployed , due to the impact of the collision though i hit the break very hard i was pushed to the car in front of me and hit them in the rear.
He got out of his car and apologized for accident and clearly told me he does not know how this happened and he was very sorry for what happened , i was getting severe shoulder pain and by the time cop came , there was an emergency vehicle and they were checking my condition , cop spoke to them first and he came to me asked and I clearly told him that I was hit in the rear and due to the impact of it i was pushed forward and hit the vehicle in front of me in the rear. he asked me if i was changing the lane and i told him that i was not changing the lane and was in the same lane but he told me that based on how the accident looks he assumed that I was changing the lane but i told the cop that i was not changing the lane. I informed my insurance about the same and uploaded some of the photos i took at the accident spot and they told me that they would wait for the report and also conduct an investigation to determine the outcome but i have a strong case
report came in today and cop has written that the back car guy who hit me in the rear told that i changed the lane and at the same traffic was slow and he did not have enough time to slow down and investigation says that all the vehicles were travelling in the left lane and back car attempted to slow down due to traffic while at the same time i attempted to change the lane to left and due to my improper lane change and back car following closely , back car struck me in the rear and also causing my car to strike car in front of me in the rear.
I am completely shocked and very worried because I was not at all changing lanes and had been driving in the same land for more than 15 min , i do not know what to do now , Can you please guide me on how to proceed
Also cab you please help me in understanding who would be at fault based on the police investigation report.
