Support Arrears: Support Arrears - Child Didn't Live with Father

My question involves a child custody case from the State of: New York

My son, who is now an adult, lives with me now. He lived with his father, or so I thought, in New York for several years. I have known for some time that his Dad never lived where he lived. My son lived with his Grandparents (who have both since past away) and his Aunt.

When we divorced (divorce was granted in Nevada), we agreed and had stated in our divorce decree that he would waive all rights to future child support (which I later find out doesn't mean a hill of beans in most states). 2 years later he files for support in NY and is granted it.

I have paid as I could and for the past 4 years have had my federal tax refund levied to pay arrears. It just doesn't seem fair or just that I am still paying for something that I should have never had to pay for to begin with.

What I want to know is can anything be done now, with the fact that he NEVER even lived with his Father.

Thank you for any advice or help.
