Repair and Maintenance: Should the Tenant Have to Pay for the Refrigerator Repair

My question involves landlord-tenant law in the State of: California

My son is renting a room in a house. He just moved in last week. He signed a month-to-month rental agreement. Three other people signed a separate agreement to rent their rooms. At the time he moved in they hadn't moved in yet. The landlord does not live in the house.

The refrigerator was making the proper noises, like it was working, when he went through the place before signing the agreement. However it won't keep food cold. The landlord insists that my son and the other tenants pay for the repair.

One clause in the agreement says "Tenants acknowledge that they have examined the premises, including appliances, fixtures, carpets, drapes, and paint, and have found them to be in good, safe, and clean condition and repair." He did hear the refrigerator humming but didn't check how cold it was.

The agreement says this about appliances:
Tenant may use stove/oven and refrigerator.
Tenant agrees not to operate or use dishwasher.
Tenant acknowledges microwave oven, garbage disposal, washer and dryer are not provided as part of the room rental lease.

There is no other mention of appliances.

Should my son have to pay for the refrigerator repair?
