My mother will be filing a 601 waiver for unlwaful residence. She was a hard working immigrant whoe helped put 2 kids through college, and then voluntarily left the country so she could return as a legal citizen. She has been overseas now for 4 years trying to get a visa but the embassy keeps asking for information we dont have.
So we have decided to apply for a i601 waiver. My question is can I as a 24 year old US Citizen child be the qualifying relative? i have heard there are new rules regarding this. If you could reference the law directly that would be great.
