Speeding Tickets: Speeding Violation for Commercial Driver with Csa Points to Be Assessed

My question involves a traffic warning ticket from the State of Ohio. Recently one of my company drivers received an Ohio State Patrol Driver Warning Notice for speeding, (6 to 10 over speed limit). There was no ticket issued however points will be assessed against the company and driver on the federal CSA program.

The driver was on major hwy in Ohio when his truck developed an severe air leak. The driver increased his speed to make it to the next exit, (about 1/2 mile distance), so that he could safely exit the highway and not break down in a major traffic lane. Once air pressure is completely lost on a commercial vehicle the brakes engage. Of course he was followed by the Highway Patrol and considering the situation the officer wrote a warning report issued to the driver for speeding instead of a ticket.

My question is, are there emergency situations when it is legal to speed, or is there another defense I can use to protest the speeding warning. Please keep in mind if this warning stay on the Safer System it will impact the companies fitness level. I have repair receipts to back up the defense.
