Hello, I'm trying to formulate a defense for a friend who has court for the infraction in about a week. She contested and did discovery. Date stamped is 6 days but it was a weekend and everything else is kosher with legal timelines (discovery is 6 days before hearing but I've previously talked to a prosecutor and was told basically "I've never seen that argument work") I can't speak to the stop as I was not personally involved but I had a few thoughts as to possible points of defense;
-the report was written and dated 2 days after the stop. Is this a solid argument and what would be the legal basis for it?
-the officer did not state any qualifications as to using the speedo
-.25 miles seems short to pace
-obvious discrepancies in the cited speed
- does not mention where she was in relation to his vehicle
- fine seems arbitrary (no "over 40" "under 40")
- has there been any precedent on this whole "unmarked vehicle" thing
Are these legitimate arguments and what would be the proper wording for the arguments? Any insight is greatly appreciated!
