My question involves paternity law for the State of: California
About to have my first child with my partner.
Intending to put him on my insurance. To do that I need to upload the birth certificate. The problem is that my partner has been separated for a number of years but her divorce is not final- so yes, she is married.
I understand that my name can't be on the birth certificate as there is a presumption that her husband is the father.
There is no dispute over paternity, but not sure how to resolve to satisfy insurance? Any insight is much appreciated.
