My question involves estate proceedings in the state of: California
My mother died this year in August, I am an only child however there is a step brother I have never met and he has never lived with my mother. Step brothers father dies 2 years ago, my mother asked him this july 2015 to come get his father truck as my mother knew she was dying. He lives in a different state and I too live in a diff state. I also came to my mothers house in July, only to find out my mother was a hoarder of stuff and animals. I had to contact the Humane society and Adult protective service. Long story .. but what I want to know is.. I am probating my mothers estate with out a will "intestate" I secured house and chained gates. Step brother has come back from his state cut the chains and stole some property, this I know as he returned product and I have a copy of the refunds checks given to him in his name. Checks should have go to my mother for her checking estate account. He has also taken a vehicle title and transferred in his name in his state and also mentioning on paperwork he is her son, he was not adopted, So I would like to know what is my action I should be taking? I am due to go to court in Jan 2016, in Pro Per. How do I get the property back into the estate, what kind of court order will it take? My mother has no money only property.
