My question involves a marriage in the state of: NY
I'm not sure that this question is on the right part of this site.
My wife and I have been living separately since August. She left in August and has been living with her parents. We have been in therapy but I see a divorce likely.
We have been married almost a year. Prior to our marriage she lived with her parents and was insured fully by Medicaid as are her parents. After marriage she became ineligible for Medicaid because my income is above the maximum for Medicaid. She has no income or assets. Since the marriage she has been on an Obamacare plan paid for by her parents. I am insured by my school's plan. The Obamacare plan premiums are being raised significantly in 2016 and her parents refuse to renew. They will attempt to get her back on Medicaid, but I don't know how.
My question is this:
a) If her parents succeed in getting her back on Medicare, but fraudulently (by misinforming them about her marriage status or something else) will I be responsible for her medical expenses if Medicaid discovers the fraud?
b) If they fail to get her on Medicaid and don't renew her Obamacare plan, will I be responsible for he medical expenses?
