My question involves court procedures for the state of: California
I was recently involved in an altercation where a car window was broken. It was a mistake, and I am fully willing to accept responsibility. But here is the dilemma. I was given an invoice to replace the window. I am willing to pay, but the invoice shows that the persons car insurance paid for it. I am willing to pay the party for their time to resolve the issue, but I know that the auto insurance paid for the repairs. I spent 9 years in the auto industry dealing with insurance companies. I am being asked to pay the amount to the attorney, or they will proceed with filing charges against me. I am considering negotiating with the attorney, as the party would like to remain anonymous. I have been told that once I pay, they will not bother proceeding with pressing charges. I feel like I am being extorted for money here. Is this not insurance fraud? Can the insurance company come after me for to recover the damages? I don't want to end up paying to replace this window twice. Is there any way I can make sure that my information wasn't given to the insurance company?
