My question involves labor and employment law for the state of: Washington
I drive a semi truck for a living and I got ticket for being overweight on my trailer axles by 1,300 lbs. I don't have any scales on the truck and I was doing my best to estimate weight based off what the crane operator was telling me of weights of each stack. My overall gross weight was under, just the distribution was off and without scales on the truck I had no way of knowing.
My boss offered to pay for half of it. The way I see it, and from talking to other drivers see it the same way, I don't have scales on the truck so if I don't have a way to know the weight I shouldn't have to pay for the ticket.
I know I can't be charged for accidental damages done to the equipment while on the job. But can I be legally made to pay for an overweight ticket if I had no way to know for sure that I was overweight?
