Emancipation: When Can a Child Choose to Not Go Home

My question involves juvenile law in the State of: Louisiana

I will try to keep this short as possible.

In July of this year, my brother and his girlfriend (they have lived together for 12 years) sent her 16 year old daughter to live with me in Tennessee.

I have a power of attorney over her for medical, schooling and such.

Since my niece has lived with me, I have learned of the mental and physical abuse she has endured due to my brothers and her mothers active alcoholism. I have not seen the physical abuse, but have heard the verbal abuse both over the phone and when they came up to visit a few weeks ago.

Since her mother found out that she is no longer eligible for food stamps and medicaid since her daughter no longer lives with them, they are wanting her to come back.

My niece is terrified and the thought of making her go back there sickens me. I am trying to find out if there is anything legally that can be done to stop this from happening.

She is a great kid and deserves so much better.

Any help would be greatly appreciated.
