Custody and Visitation Issues: Is There a Way to Get More Time

My question involves a child custody case from the State of: Washington

My ex wife and i have been divorced for about 4 years. While married, we had 2 children together.

In the marriage, I was the bread winner and she was the stay at home mom. But since, things have changed as she now also has a full time job.

I understand that the state gave her custody because of her open schedule and she was previously the caretaker. But now that she has the same amount of time away from the kids as I do, and I make most of the care appointments, is there a chance to get a more even amount of time?

We live on the other ends of a smaller town, approximately 15 miles from each other. She lives with her mother, and has since the divorce, somewhat in a country setting. I live in the town, blocks from an elementary school & park, and have several neighbors with children of the same age (one child is 9, the other is 6).

The 9 year old is wanting more interaction with people her own age, and wants some independence from her brother. I do not want to split the 2 up, at all, but want to give them a life where they can be kids with other kids their own age.

Currently, their mother has them Monday - Thursday, I have them Friday - Sunday 3 weeks and the fourth week I have them on a mid day visit. This schedule is the same during the school and summer months.

I know when this is read, it will be thought that I have my kids enough time, but I want to have more decision making in their lives.

Ideally, I would like the summer schedule split where the parents have them 5 on, 2 off, with the schedule rotating around the weekends so we both get weekend fun.

If their mother doesn't agree through mediation, am I going to have any luck in front of the Judge/Commissioner?
