My question involves a condominium located in the State of: Ontario (Canada)
I am a first time buyer and recently bought a condo townhome - the place was in perfect condition and move in ready. We were thrilled!
Come spring, we were advised there was a leak coming from our condo into the underground. We are in a low rise 2 level building, and I am on the bottom level above the car port. There was a small drip of water coming from my utility closet directly into the garage.
We had the condo corps engineer come in to take a look - he shows up at about 8 am on a Friday, starts ripping up the floor without saying a word, and drills a large hole into the utility closet. He pulls out some insulation which is clearly frozen and indicates it is wet. It is a bit damp, and after speaking with a contractor that same day, we were advised it is common for insulation to freeze and be mildly damp under the floors. We thought nothing of it until we got follow up from the condo corp indicating the engineer reported "pooling water" under the floors, and they are demanding we pull up the floors and replace the damage.
Later into the investigation, we decide to pull up the floors in the utility closet and confirm if there was any water coming in from another source just to appease the condo corp. When we pulled up the floors we were surprised to find about 1.5 inches of standing water on the spray foam and a hole about 5 inches in diameter that went directly into the underground. We then started to get a picture together - the previous owners had a flood (their own cause) and had insurance clean up all the water and replace all the wooden joices, foam, insulation and relay the floors. When the sprayed the foam, they covered it up right away before it dried and didnt realize the foam leaked through the hole into the underground leaving a massive hole under the plywood.
So this shady repair caused the AC line to freeze where it leaks out, which caused the water to leak out into the subfloor, and just sit. The hole was allowing cold air to come in over the winter, which caused it to freeze and sit there all winter. Once spring came along it started to defrost, and luckily leaked for the most part right into the underground, preventing any major damage. It is definitely contained to this one area, the hole has been blocked, the AC unit has been fixed and there has not been any wetness since.
The condo corp will not take any responsibility, will not release details for the engineer who stamped the previous repairs, and is now threatening legal action against us if we dont replace everything. Does anyone have any insight as to what our options are? We havent even owned this unit a full year at this point.
