Can Someone Gift Me Money to Spend on My Mother and My Mom Not Lose Public Benefits

Thanks in advance for your answers.

My grandfather passed around mid 2018. My aunt who he lived with and took care of him was the co-owner and beneficiary on all of his accounts so my understanding is that 100% of all his accounts default to her once he passed. There was no estate, trusts, or will ever set up. Supposedly he once wrote a hand written will but it was never notarized so it holds no legal value.

My mother is below poverty level and her only income is about $800 per month from social security.

My aunt wants to give my mother around 80k however that would cause my mom to lose certain public benefits she currently recieves like medicaid, premium free medicare part A & B, food stamps, and HUD subsidized housing.

In order to maintain my mothers benefits and not put her in a worse financial position than she is currently in, could my aunt simply wire the money to my account and then I could pay off my mothers car, any small debt she has, and moving forward when she needs something I can buy it for her online and have it shipped to her deducting it from that money?

My understanding is that if my aunt did this she would have to file a gift tax return since the amount exceeds 15k however it would not be subject to taxes unless she exceeds the lifetime exemption gift amount which is over 5 million.

Thoughts?

Expungement and Sealing: Seal/Expunge a Record with Charges Dropped

My question involves criminal records for the state of: California

An event happened 15 years ago where I was charged with something, but where it was eventually dropped (never went to any trial and I never saw court, judge, or anything like that).

A few months ago, I went to the police station here in the Los Angeles area, and requested to see what is on my record? I payed a fee, they took my finger prints, and then they did an investigation to pull my records and send anything they can find to my home address. This process took a few weeks.

And sure enough, once I received the investigation report there it was: something I was charged with, that was dropped. But, now I have more information to its existence.

Being that so many years have passed, I'd like to expunge or seal my record to get this off if possible. However, I'm not sure what the next steps are? I have a piece of paper stating what charges where to potentially to be filed against me, but it was dropped and dismissed.

Is there someone maybe at the Los Angeles Superior Court (Van Nuys or otherwise) that I can call? Someone further there that I should maybe talk to about this?

Separation: Eligibility for Subsidized Housing: Separated Elderly Parents

After 50+ years of an unpleasant marriage, my parents have separated (i.e., living apart, but with no legal action (yet)). My mother (early 70's) lives in an assisted living facility in Wyoming, and my father (early 80's) has moved (temporarily) into my home in Washington. They have moderate income (his state retirement + SS for both). They also own their home (now vacant) and some CD's.

We've been looking at senior apartments for my father. Because nearly half of his income goes to pay for my mother's assisted living facility cost, his available income is low, and in fact, is well below the limit for low-income housing. Unfortunately, all of the subsidized housing we've looked at makes no allowance for my mother's housing expenses, and considers his full income in their calculation, placing him above the eligibility threshold.

So here's the question: are there any legal options available which would enable him to exclude my mother's housing expenses from his income? Divorce is a possibility, but my assumption is that the divorce decree would essentially require him to pay maintenance for my mother, which is what he's already doing, so wouldn't really change anything (since I don't see anything on the housing subsidy application that allows former spouse maintenance to be excluded from income).

Suggestions?

Husband Willfully Letting Marital Home Go into Foreclosure

My question involves a marriage in the state of: Vermont

My husband, we are currently in the process of divorce, has not paid the mortgage in 4 months.

I am not on the mortgage but was told at the beginning of the divorce that all property in Vermont is marital property whether it's in one name or both.

We were attending case managers conferences to determine the distribution of assets and I now find out that the mortgage company is beginning foreclosure on the home.

I requested all bank statements from June 2018 to current, and going through them my husband has spent thousands of dollars on dating sites/ porn/ etc. and the totals of those purchases would have been more than enough to cure the default.

I was told by a friend of both of ours, that he is planning on letting the house be foreclosed on and that his parents will purchase it at a fraction of the homes current value.

My question is, can I do anything about this? Can he actually willfully let the house be foreclosed and his parents buy it for him to still live there?

Sentencing: Help

My question involves criminal law for the state of: us district court. I was serving 17 years in ms state prison. In 2015 I caught federal tax fraud and identity case. I pled guilty and psi was done. In psi, po included the state conviction for the sentence i was serving at time I committed federal crime. ( I complete 17 state years on March 15 2019). Anyway, the psi relied on this state conviction to determine offense level and criminal history score on federal case. I found cases say that in that situation , the usdc judge must order concurrent sentences. Is that good law? Or will bop compute federal sentence as concurrent once I arrive in federal custody?
