Cosigners: Two Cosigners Live in Different States from Where Original Loan Originated

My question involves collection proceedings and statute of limitations in the States of: Michigan, NY and Georgia

My wife and mother-in-law cosigned on a private student loan in Michigan back in the early 2000s for my wife to attend school in Georgia (they applied online). Due to unfortunate circumstances, the loan went into collections in 2006. However, they had made a payment arrangement and were paying regularly. My wife was already living in Georgia when it was in collections and my mother-in-law moved to New York in 2014 while it was in collections.

The loan was sold to another collection agency back in 2011 and my wife inadvertently missed a payment back in October 2015. Since then she has not made a payment as we learned through our web research that we could send a letter to the collection agency requesting original documentation that they owned the original loan. Since October 2015, the loan has been sold repeatedly and no one has been able to furnish original documentation that they own the loan. Every time we request original documentation, they send copies of old faxes then disappear and we then hear from a new collection agency or law firms acting on behalf of the collection agency months later. However, my mother-in-law is concerned about how long this whole process will take and based on my research I understand that the SOL would dictate the amount of time a debt collector could legally sue. What I am not aware of and cannot find information on is which state's SOL would take charge here.

Again:

- the private student loan originated in Michigan, for use to attend a Georgia college
- my wife has not lived in Michigan since the loan was originally opened
- my mother-in-law, the other cosigner, relocated to NY in 2014
- last payment made (as part of verbal agreement) was in October 2015

I would really appreciate if anyone can explain to me which state's SOL take charge here. Also, I read somewhere that Georgia's SOL may actually be 4 years for private loans, but the majority of my research shows it is 6 years, like the other two states. So I'm hoping someone can clarify and confirm what is Georgia's SOL. Thanks in advance!

Following Too Closely: Is There Any Basis for My Defense of a Following Too Closely Ticket

My question involves a traffic ticket from the state of: New York

Hello and thanks in advance for any guidance. I was issued a ticket yesterday after a minor collision for Following Too Closely. Here are the facts:

I was traveling down a road that splits from 1 lane to 2 lanes. Driver in front of me stayed straight (just right of the center line) and I shifted to the right lane as I was going to be turning right about a half mile down the road. Road is two car widths wide at this point and I am basically in what would be considered the drivers blind spot. Front left of my car is closest to right rear of his car.

He then abruptly makes a right hand turn, across the front of my car, without signaling, into a strip mall entrance and the front left of my car contacts the right side of his car (behind passenger door). To me, I felt like I was cut off and he was on the far left side of the a 2-car width road making a right hand turn.

Important fact that would aid his defense is that while the road is two car widths wide, the actual stripe marking the two lanes starts on the far side of the driveway he was turning into. Not before the spot we collided.

So when the officer showed up he asked us both if the driver signaled, I said no (which I really believe to be true, I wouldn't pass someone on the right if they were signalling right). The driver said that yes he did signal.

I was issued a ticket for following to closely.

Do I have any basis to defend following too closely? Obviously the failure to signal is a he said/she said. Does following too closely have to be a direct front to back type of collision (evidence clearly would show I was an entire car width to the right of the driver). Also the question of when the two lanes begins in the case when the road divides.

Thanks in advance, and if I am wrong I will accept my punishment.

Sales Agreements: Sold Car Before Carfax Was Updated

One week ago my wife got in a small accident. Insurance paid for a new bumper and fender, no structural or mechanical damage was done to the car. All damages were repaired and it even got a new paint job.

We got the car back and sold it that same night before the Carfax system updated. This means we sold and signed paper work saying that the car was never in an accident.

Can the dealership come back at us for this? It

The Damage disclosure agreement says," Has this vehicle been damaged by collision or other occurrence to the extent that damages exceed 25% Yes No
of its value at the time of the collision or other occurrence? (Applies to 5 Model Years old and newer)
If yes, list parts that were damaged.". The car is a 2010, so it is over the 5 years old line.

Workers’ Compensation Claim

My husband suffered a serious injury at a construction site he was working in. We thought he was only eligible for benefits under workers’ compensation. However, a friend of mine informed me that we could also file a claim for lost wages and medical expenses. Is it true?

Termination: Never Served, Ex Lied So She Could Get One by Default

My question involves restraining orders in the State of: California

So my wonderful ex filed a DV restraining order against me, claimed i was served (had a friend lie and sign and notarize it), had the hearing without my knowledge.

I just found out about this, is there anything i can do? This is going to mess with everything in my life including my job. The crazy part is i want nothing to do with her and have changed the locks on my doors, my phone number, etc. i catch her constantly driving around my house (like every other day, she lives nowhere near me), tries to contact me thru friends, etc. its a real life fatal attraction. The law always seems to side with her as well, no matter how crqzy things get, it’s insane.

I already know shes going to harass me nonstop until she can trick the cops into making it look like i violated my RO.
