Appeals: Procedendo Case Dismissed

My question involves court procedures for the state of: Iowa

The court of appeals reversed and remanded my small claims appeal back to the local magistrate, only to have her dismiss the case again.

Do I have to re-appeal this again? or is there some procedure to to ask the court of appeals to look at the dismissal again? Iowa law is not real clear on this one.

This is a pro se consumer case against a california company that was dismissed for jurisdiction.

Agents and Brokers: Material Change = Nullified Listing Agreement

My question involves real estate located in the State of: North Carolina.

I own two houses that are for sale. They are separate legal parcels but are right next to each other.

Listing agreement #1 is for House A and the land it is on, currently priced at $170K.

Listing agreement #2 is for both House A and House B together and all of the combined land, and currently priced at $525K.

There is no option in listing agreement #2 for either house to be sold individually.

What happens to listing agreement #2 if House A sells individually under it's separate listing agreement? Would this constitute a material change under which I could cancel Listing agreement #2 without penalty?

I am completely dissatisfied with my Realtor, and would like to sell House A as soon as possible, and then re-group with House B off the market for a bit. I strongly questioned the Realtor's suggested list price for House A, which seemed way too high to me. I deferred to the Realtor's expertise after MUCH encouragement from him, and listed at the price I was advised to list at, which was $220K. House A has now been on the market for over 2 months with exactly *1* phone call and subsequent showing, and this despite 2 price drops initiated by me totaling over $50K, and I am STILL not sure it's priced correctly. It's been listed at the current $170K for two weeks without a single phone call, and meanwhile there have been 11 houses in this area at the price range I think is correct ($160-ish) that have gone under contract in the last 3 weeks. I can understand an agent being off by $5-10K, but being off by $50K+ in this price range is ridiculous.

Outside of the pricing "controversy" over House A, the first week on the market for the package of both houses hasn't been impressive. The listing agreement was signed last Thursday, and only yesterday (Thursday) did the agent make it out here to put a sign and brochure on the property, and that after 2 phone calls from me asking about it. Apparently he "ran out of signs" and had to go get one from a different listing. Unfortunately, he forgot the lock box, so there's not a lock box on House B yet. And zero phone calls this first week on the package parcel, either. And yes, believe it or not, this agent is with a national company I can guarantee you have heard of.

I know there are options to terminate either or both listing agreements, but I'm not interested in paying for advertising costs or listing costs that net me nothing. If listing agreement #2 dissolves with the sale of House A (since #2 is a package deal only) , I am planning to drop House A to what I think is the correct price range and sell it. I'll re-direct with House B after i have had the chance to work out different plans........maybe FSBO or perhaps rent it out or some other option, or with a completely different agent/company. I may also just delay selling House B until next spring, too....my original plan was to buy land and build a house, but I was up against a time line due to work travel this fall. I may just wait so I'm not halfway across the country when the new house is being built.

I am facing an issue relating to a gift card worth of rupees 25699 of amazon the card was actually gifted to someone else as he don't want to buy any thing he have given that gift card to me to make purchase I have redeem the amount on amazon.in site and used the amount to make purchases from amazon. Now the problem arises he have claimed that the gift card was hacked and used by someone inspite of the fact that he himself provided me the card to make purchases I have received the purchased items from amazon and haven't open the packing.

Please suggest me what to do now because I have no proof to claim that the card is bring provided or gift by the owner of the gift card to me on his acceptance.

Recently, i was driving my F-450 heavy duty ambulance, that i converted to my daily utility truck. I was ticketed for driving my truck in a no truck zone. i was really curious to see if my car falls into the category of a truck or utility van. I had weighed the vehicle and it came out to be 9,600 pounds. Please if anyone can help me out with this, I'd really like some legal advice on it.

Thank you in advance to anyone who can help me with what to do and the laws.

My boyfriend (exnow)and I had an argument one night, he was falsely accusing me and yelling. We were in our bedroom, I told him to leave if he's going to be acting like that. He went crazy, yelling, he pulled his clothes drawers out and started packing his bags. While he was doing that I told him to not come back until he controls his temper. He yelled a crazy yell and slammed his head in the drawer on our bed and was bleeding in the front of his forehead, he was still yelling and saying all this stuff so I stayed away from him. I asked him if he needed to go to the hospital. He just said he wasn't coming back and took his bags and left.

After he left I locked the doors and put my son to bed who was in his room the whole time playing. I went to sleep after I called myex to see if his bleeding stopped and to make sure he went down the road and wasn't coming back that night. He said he wasn't coming back.

I was extremely tired after working the whole day so I went to bed. I live an hour and 20 min away from the closest relative and since I didn't think he was coming back I went to sleep.

well early in the morning I think around 1 am I was awoken, still half asleep I heard people talking coming down our hallway. Unfortunately my door was not closed and I grabbed my phone to call 911 but by that time his sister and 3 other girls and him were in my bedroom while I was still in bed.

They demanded i leave and his sister grabbed my phone saying what is this. I told them to leave my room and get out of my place. His sister told the 2 others to grab me while she did and the other girl held the door open. I told them to get off me and tried to grab my phone and they threw it down and were pulling me. I heard him say get her out of here and the one girl said be careful shes pregnant. His sister said who cares its probably not my brothers (which of course it is). One of the other girls that were holding me said her face isn't pregnant. Then they just kept dragging me. I grabbed onto the door and the one girl started punching me in the side and put her nails in me on my arm. His sister was yanking me and punched me in my side and arm multiple times while dragging me and put her nails in me. There was also a third girl grabbing me saying how strong I was to be this small. his sister is huge compared to me and all the other girls were all double my size.

Keep in mind I 5mths pregnant and only had a small white tee and sleep shorts on so got scratched and a few bruises on me. Also We have a long hallway. They were hitting me and dragging me down the hall.

I screamed for my son to wake up so he could be a witness which he saw some of it.

They threw me out the patio door and I fell but not on my stomach I thankfully fell a certain way that protected my stomach and baby. lived on the bottom floor. They locked me out.

I ran around looking for someone in the parking lot so I could call the police. There was a man getting out of his car who I asked to look in my apt so he could witness the girls but he said he couldn't see in there because they closed the blinds. And he said he didn't want to get involved. There was another man in the parking lot who said the same thing. I found out later both of them did end up calling 911. I ran to the main street and flagged someone down who let me use the cell phone and called 911. During that time my ex left with my son & the 4 girls. When the police arrived they saw me distressed with the scratches and bruises and in my same clothes and I was still locked out because I didn't have my keys. They said they couldn't go find him with my son.

I was threatened with killing if I filed charges on them. I was scared but now I don't care because they could have injured my baby so I hope they all rot. I only know his sister but don't know the other 3 girls. What kind of time will the sister be facing? how can the other 3 girls be found? Also my father asked my neighbor above and she said she heard screams and noises and also saw him and 4 big girls leaving.

I want to know what kind of time will his sister most likely get. I know she doesn't have a criminal record and is 19 or 20 but she is an aggressive person. She is also huge and dresses and acts like a man. She calls herself a dyke because she is a lesbian. I don't know anything about the other girls other than 2 of them were very aggressive and assaulted me while one was saying things and holding the door but didn't touch me. What charges will they be facing?

Also if I file charges on the sister without knowing the other girls will they give his sister a lesser charge just because I don't have the names of the others?

also should I file charges on him or will they do that automatically when I file against his sister?

Also what is the statute of limitations on this kind of case? How long do I have to file these charges. I am not going to be scared and let them get away with this crime.

I did go to the hospital and they did a sonogram and said my baby was thankfully ok. I already filed a protection order against him.

he also filed a protection order against me. He said i hit him with the drawer which is not at all true, he also had told his sister this. I didn't even touch the drawer and it was still in the same spot. He called me and told me he did it so I couldn't keep and stay in our apt while he pays the rent and has to leave. This happened before because I filed an order against him years ago when he put his hands on me before and slammed me into a wall. So now he is lying. If I record him saying that will I be able to show the evidence in court or can the police set something up to record him. Because I have asked him why he would do such crazy things and possible harm our baby and he says everything on the phone telling on his self.

If anyone ever reads this and is/was in a similar situation they never change. I think even with counseling if a man goes that far to put his hands on a woman especially when noone touched him and when their bigger and stronger then that's in them and they can do it again and most likely will. Leave now and never look back there are so many others that would never have an excuse to hit or assault a woman whether pregnant or not. Yes this time he didn't actually touch me but he had his sister and others do it. So he is capable of much more.

Disability Benefits: Tanf and SSI

I was just given a fully favorable decision by the ALJ. I have been receiving TANF and food stamps for the last 2 years. My question is, once I receive my SSI backpay, do I have to repay the state for the TANF and food stamps that I have been received? I am looking at about 22 months of backpay. I have been searching on Google for this answer, but have found both yes and no. I am just wondering what to expect. Thanks!

Out-of-State Marriage: Consequences to Claiming You're Single if You Married Abroad

My question involves marriage law for the State of: NJ

My husband and I registered our marriage almost 7 years ago in Taiwan (and both US citizens). We were (and still are) madly in love and it was a little bit of a rash/quick decision. Although young, we were legally able to do so there. In that time, we did not to disclose our marriage (aka filling out "single" on forms whenever it arose). However, now that we are about to have our actual ceremony here soon, we are faced with a two-part dilemma:
1. Do we need a US certificate of marriage? (scanning this forum, it seems like this answer is no)
2. Are there any consequences of us saying that we were single when, from a Taiwanese perspective, we were not?

I am potentially about to start a new job overseas in UK and I am wondering if I will have to provide documentation as a part of my job package. It would be best if I can use a recent US certificate.
